The case between JOE-KYARI GADZAMA v. INCORPORATED TRUSTEES OF
NBA & 8 ORS with Suit No. FCT/HC/CV/2364 has once again
commenced in the year 2018, before Hon. Justice Adeniyi of Court
20, FCT High Court, Apo for continuation of hearing.

The case which hearing began last year being 2017, had the
plaintiff’s first witness testified before the court before the
matter was adjourned for continuation of hearing. Continuation of
hearing bagan this year with the Plaintiff’s 2nd witness, Nwaugo
Victor Chima, former NBA National Legal Adviser giving his
testimony.

Victor Nwaugo in testifying told the Court how Augustine Alegeh
(SAN) – 8th Defendants campaigned for A. B. Mahmoud, SAN (9th
Defendant) and unduly influenced the 2016 NBA National Officers’
election.

Some DVDs showing the anomalies displayed in the election were
sought to be tendered in court in evidence but were objected to by
the defendants. Court however, overruled the objection challenging
the admissibility of the DVDs showing the anomalies in the
situation room, during the NBA 2016 National Officers’
election.

The said DVDs were tendered through PW3 who is one, Mallick
Bolakale, one of the Plaintiff’s agents during the 2016 NBA
elections and admitted in evidence as Exhibits P6 & P6B.

The DVDs admitted in evidence were played in open Court showing
the swapping the computer used at the NBA situation room at the
former NBA Secretariat, for the electoral process with another one
with a pre-installed data for the display for the 2016 NBA national
officers election to prove the case of the plaintiffs.

The matter was adjourned to the 12th January, 2018 for
continuation of hearing with PW3 to be cross examined.

TheNigerialawyer recalls that PW1 by name Pastor Emmanuel
Oluwabiyi had once testified before the court that the election was
marred with irregularities.

Chief Sebastine Hon, SAN with Johnnie Egwuonwu SAN led a team of
lawyers for the Plaintiff; Yunus Ustaz SAN led a team of lawyers
for the 1st Defendant while Paul Erokoro SAN led a team of lawyers
for the 15th Defendant. K. K Eleja, SAN with a team of lawyers
representing the 2nd to 6th Defendants; A. A Malik Esq with a team
of lawyers appeared for the 8th Defendant (Augustine Alegeh) while
Ede Uko Esq with a team of lawyers represented the 7th Defendant
(Grace Infotech).
