PENALTY FOR SEXUAL OFFENCES IN THE
MILITARY.
In Nigeria, it is an offence for a Military personnel to have
Sexual Intercourse with the spouse of a fellow military
personnel.
PENALTY
5 years imprisonment.
However, for a person to be convicted of this offence, there
must be evidence of an eye witness.
See Section 79 of the Armed Forces Act.
From the wordings of the Section and with the express mention of
“Carnal knowledge” (Sexual Intercourse) it would appear that such
affair will not amount to an offence if:
(a) sexual intercourse was not involved.
Or
(b) it involved “sexual intercourse” but with the wife or
husband of a civilian.
