PENALTY FOR TAKING OR ENTICING THE WIFE OF ANOTHER
MAN.
In Nigeria, it is an offence to take or entice away the wife of
any other man.
PENALTY
Imprisonment for a term which may extend to 2 years or with fine or
both.
See Section 389 of the Penal Code Act.
In 2017, the Supreme Court per Ogunbiyi JSC affirmed the
conviction and sentencing to two months in prison of a Professor
and a lecturer at the Ahmadu Bello University, Zaria, for enticing
a married woman.
According to the evidence adduced by the Prosecution, “the
accused had been warned severally by the husband of the woman both
face to face and on phone to stay away from her.
“He had refused to heed until he was caught red handed with the
woman in a hotel room.
