Controversial Conflicting Order: Petition NJC Against Hon. Justice Njoku Of Ebonyi State High Court For Incompetence — Lawyer Urges NBA

*Calls Also For Sanction Against The Lawyers Who Moved The Exparte Application
A member of the Nigerian Bar Association Public Interest Litigation Committee, Wisdom Meni Adike, has expressed concern over the new Exparte Order by the Ebonyi State High Court staying the execution of the order of the Federal High Court, Abuja, which directs the removal of the Ebonyi State Governor and his Deputy.
Adike, in an open letter sighted by TheNigeriaLawyer, described the situation as a show of shame and disgrace to the legal profession.
He said, “Today the Legal profession witnessed another show of shame and disgrace, as My Lord, Justice H.A NJoku of the Ebonyi High Court put the legal profession to another display of shame and disgrace. By using an Experte Order to set aside a Judgment of the Federal High Court, issued against the Governor of Ebonyi State.
“This is a clarion call to members of the legal profession. That it is time for us a gentlemen of the legal profession to rise up to the occasion non-violently within the ambit of the law. Toward seeing that such show of shame and disgrace ends with Justice H.A Njoku of the Ebonyi State High Court, or we all shall fall as a profession, from the wipes of greed and Corruption showcased today in our Nation’s Judiciary.”
He therefore called on NBA to ask for removal of Hon. Justice Njoku for gross incompetence. He also urged the NBA to call for suspension and disbarment of the lawyers involved.
“It is on the above, I humbly recommend to the NBA as a member of the Public Interest Litigation, NBA National, as follows:
“1. The call for the removal and sanction of My Lord Justice H.A Njoku for gross incompetence shown and shame rubbed to the face of the legal profession and it’s members.
“2. The call for the suspension and disbarment of any lawyer found to have moved this vexatious, provocative and disgraceful Motion Experte, clearly amounting to an infamous Conduct not befitting of a Counsel, and a disgrace to the legal profession in Nigeria.
I so humbly recommend.”
The statement was copied to the President of the NBA and his First Vice-President, Olumide Akpata and John Aikpokpo-Martins, respectively. It was also copied to the NBA National Welfare Secretary, Mr. Kunle Edun.
